Beta scope

The separately named RootsLanding Beta is prerelease software governed by the Supplemental Beta Terms in addition to applicable Microsoft Store terms. Its temporary free Beta hosting is separate from the commercial hosting subscriptions described in these Terms of Use.

1. Agreement and relationship to the Microsoft Store terms

These Terms of Use are an agreement between you and RootsLanding LLC and apply when you acquire, install, use, or purchase services for RootsLanding. If RootsLanding is acquired through the Microsoft Store, the applicable Microsoft terms also apply. These terms add publisher and optional-service conditions; they do not replace Microsoft terms except to the extent Microsoft permits additional publisher terms.

If you do not agree, do not acquire, install, use, or purchase optional services for RootsLanding.

2. Software purchase, license, and availability

RootsLanding 1.0 is Windows desktop software. The base U.S. software price is $29.99. The Microsoft Store may display taxes, market-specific pricing, payment methods, refund rights, or other transaction terms that apply to your purchase. Microsoft controls the Store transaction and Store entitlement under its applicable terms.

A software purchase does not include optional RootsLanding hosting, domain registration, internet access, Microsoft account charges, third-party services, or separately branded products or services.

3. Local files, preservation copies, and backups

You retain your rights in photographs, videos, stories, documents, and other materials you use with RootsLanding. For supported photos and videos you select, RootsLanding leaves the selected source files untouched and creates exact local copies inside the Digital Family Home. It also creates separate web-ready images, thumbnails, video versions, and other generated website files. These copies require additional local disk space.

Copies stored on the same computer do not replace an independent backup. You are responsible for maintaining independent backups of irreplaceable family material and for the security and operation of your own computer and storage devices.

4. Optional publishing and hosting subscriptions

Online publishing and hosting are optional. If you choose to publish, generated website files, including web-ready images, thumbnails, video versions, text, and related materials, are transmitted to hosting infrastructure so the Digital Family Home can be available online. Exact local preservation copies remain separate from those generated publishing files.

RootsLanding offers separate 20 GB hosting subscriptions through the Microsoft Store at $19.99 per year or $1.99 per month. Hosting is separate from the $29.99 software purchase. The Microsoft Store processes hosting subscription billing, renewals, cancellations, applicable taxes and refunds, and payment-card data under Microsoft's terms and privacy practices.

The monthly and annual hosting subscriptions each include a one-month trial for eligible customers. The Microsoft Store may require a valid payment method to begin a trial. Unless you cancel before the trial ends, the trial automatically converts to the selected paid subscription and Microsoft charges the first monthly or annual subscription price, plus applicable taxes. Trial eligibility is determined separately for each Store subscription product and may be limited by Microsoft Store rules. If you cancel during a trial, hosting remains entitled through the end of that trial and does not convert to paid service.

After the trial or initial paid term, the monthly subscription renews monthly at $1.99 and the annual subscription renews annually at $19.99, plus applicable taxes, unless you cancel or turn off recurring billing before the next billing date. Manage or cancel the subscription through the Microsoft account used to acquire it. Cancellation normally stops future renewal and preserves the hosting entitlement until the expiration date shown by the Microsoft Store, unless Microsoft grants a refund or applicable law requires a different result.

The 20 GB description is the included hosted-storage allocation for the generated website files and other materials RootsLanding transmits to operate your hosted Digital Family Home. It does not state or promise that RootsLanding 1.0 automatically blocks uploads or applies an automated hard limit. If hosted usage exceeds the included allocation, RootsLanding may contact you and may require you to reduce hosted content or make another arrangement before further publishing or continued hosting.

Choosing not to purchase or continue hosting does not delete your local Digital Family Home and does not by itself revoke a Microsoft Store software entitlement.

5. Family materials, permissions, and responsibility

You are responsible for the content you choose to add, publish, or share and for confirming that you have the rights and permissions needed to use and share materials involving other people. You permit RootsLanding LLC and its service providers to process materials you deliberately submit to an online feature only as needed to provide, secure, maintain, moderate, and support that feature. The Privacy Policy describes relevant data practices.

6. Hosted content rules and reports

Hosted Digital Family Homes are subject to the Published Content Policy. RootsLanding LLC may review reported hosted material and restrict, suspend, or disable hosted access when permitted by these terms, the Published Content Policy, applicable law, Microsoft Store requirements, provider requirements, or serious safety and security concerns. Suspending hosting does not delete or alter the local Digital Family Home.

Copyright notices and counter-notices may be sent to copyright@rootslanding.com. Other hosted-content concerns may be submitted through the Report content process. Closing a report, releasing a preservation hold, restoring hosting, and permanently disposing of retained material are separate actions.

7. Support and feedback

You may contact RootsLanding for support and may provide candid feedback, problem reports, and suggestions. You permit RootsLanding LLC to use feedback you provide to test, maintain, improve, and develop RootsLanding without an obligation to implement it or compensate you. This permission does not transfer ownership of family materials or other content you submit only to demonstrate a problem.

8. Acceptable use

You may not use RootsLanding or its hosting to violate law or another person's rights; distribute unlawful, harmful, or infringing material; attempt unauthorized access; interfere with the software, Store, hosting, or related systems; bypass access controls; introduce malicious code; misrepresent affiliation with RootsLanding LLC or Microsoft; resell or transfer access contrary to applicable terms; or use published content in a way that creates a material privacy or safety risk.

9. Proprietary software and open-source rights

RootsLanding LLC and its licensors retain their rights in RootsLanding's proprietary software, branding, and services. Except where applicable law or a controlling third-party license permits it, you may not copy, distribute, rent, lease, sublicense, disclose, reverse engineer, decompile, disassemble, or attempt to derive proprietary RootsLanding source code.

Nothing in these terms prohibits reverse engineering, decompilation, disassembly, modification, or related acts solely to the limited extent necessary to debug modifications you make to an LGPL-covered library distributed with RootsLanding or to exercise a right expressly granted by an applicable open-source license. Third-party software remains governed by its license. See the Open Source & Third-Party Software page and Supplemental Open-Source License Terms.

10. Hosting expiration, suspension, and termination

Your hosting entitlement ends on the expiration date reported by the Microsoft Store unless it renews. On or after expiration, the hosted Digital Family Home may become unavailable and RootsLanding may disable publishing or hosted access. Expiration, cancellation, suspension, or deletion of hosted files does not delete or alter the Digital Family Home stored on your computer and does not by itself revoke the separate software entitlement.

RootsLanding may delete hosted files after the hosting entitlement expires or the hosted service otherwise ends. Operational copies, backups, logs, transaction records, and material subject to a security, moderation, dispute, or legal hold may remain for a limited period as described in the Privacy Policy. RootsLanding does not promise that expired hosted files can be recovered or exported, so you must keep the local Digital Family Home and independent backups.

RootsLanding LLC may suspend or end optional hosted access if you violate these terms, create a security or legal risk, misuse access, or when the service must be changed or discontinued. Hosted-service restrictions are distinct from the local Digital Family Home and from Microsoft Store software entitlement.

Provisions that by their nature should continue, including ownership, feedback permissions already granted, disclaimers, limitations, open-source license rights, and obligations concerning retained records, survive termination to the extent applicable.

11. Disclaimers and limitation of liability

To the fullest extent permitted by applicable law, RootsLanding and related services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted operation, or data preservation. Keep independent backups and do not rely on RootsLanding hosting or a single computer as the only copy of irreplaceable material.

To the fullest extent permitted by applicable law, RootsLanding LLC and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss or corruption of data, profits, revenue, goodwill, or business opportunity arising from RootsLanding. These terms do not limit rights or liability that applicable law does not allow to be limited or excluded.

12. Changes and contact

RootsLanding LLC may update these terms prospectively as the product, services, pricing, or legal requirements change. Material changes will not retroactively take away rights already granted under a controlling open-source license or rights that applicable law does not permit us to remove.
